For the purposes of these Terms of Service ("Terms"), the following definitions shall apply:
By accessing or using the Service, Users agree to comply with and be bound by these Terms. If a User does not agree to these Terms, they must not use the Service.
Design-tokens.io provides a platform for managing design tokens, collaborating within teams, and exporting design data to various tools. The Service is available through a web application, Figma plugin, and integrations with third-party software.
When registering for an account, Users must provide accurate and complete information. They are responsible for maintaining the confidentiality of their login credentials and must not share them with third parties. Any unauthorized access to an Account must be reported to design-tokens.io immediately. Users are also responsible for ensuring that their use of the Service complies with all applicable laws and regulations.
The Service is offered under different subscription plans, including a free plan with limited functionality, a Pro plan available through an annual subscription, and an Enterprise plan with customized conditions tailored to specific business needs. By subscribing to a paid plan, Users agree to the applicable pricing, billing cycles, and payment obligations.
All payments are processed through LemonSqueezy, and Users acknowledge that their transactions are subject to the terms and conditions of LemonSqueezy (https://www.lemonsqueezy.com/buyer-terms). Subscription fees are charged in advance for the selected billing period and are non-refundable except where required by law. Design-tokens.io reserves the right to modify pricing and subscription terms, with any such changes taking effect at the start of the next billing cycle.
Users may cancel their subscription at any time by contacting support via email. Upon cancellation, access to paid features will continue until the end of the current billing period, after which the account will revert to the free plan unless otherwise specified in an Enterprise agreement.
Design-tokens.io grants Users a limited, non-exclusive, and non-transferable right to access and use the Service in accordance with these Terms. This license is strictly for the User’s personal or internal business use and does not grant any rights to sublicense, resell, or otherwise exploit the Service for commercial gain without prior written consent from design-tokens.io. Any unauthorized use, reproduction, or distribution of the Service beyond the scope of this license is strictly prohibited.
Users must use the Service in compliance with all applicable laws and regulations. Any unauthorized or illegal use, including activities that infringe on intellectual property rights, is strictly prohibited. Users shall not interfere with or disrupt the Service, its infrastructure, or associated networks in any way that could impair functionality or availability.
Excessive API requests or other abusive behaviors that could degrade performance or negatively impact other Users are not permitted. Design-tokens.io reserves the right to take appropriate action in response to any violations of these restrictions.
Both parties agree to keep Confidential Information secure and not disclose it to third parties, except as required by law or with prior consent.
User data is processed and stored in Supabase, which operates under its own Terms of Service, Privacy Policy, and Data Processing Agreement. Payment and client information are handled by LemonSqueezy, subject to its Privacy Policy and Data Processing Agreement.
The collection, processing, and use of data are governed by our Privacy Policy, which Users should review to understand how their information is handled.
While we implement safeguards to protect against data loss, no system is entirely immune to potential disruptions. Users are encouraged to regularly export and back up their data to ensure its availability.
Users retain ownership of any design tokens and related content they create within the Service. However, by using the Service, Users grant design-tokens.io a limited license to store, process, and display such content as necessary to operate the platform.
All rights, title, and interest in the Service, including its proprietary software, trademarks, and features, remain the exclusive property of design-tokens.io. These Terms do not grant Users any rights to use the design-tokens.io name, logo, or other brand elements without prior written consent.
The Service integrates with third-party providers, including Webflow, Firebase, LemonSqueezy, and Supabase, to facilitate hosting, authentication, payment processing, and data management. Users acknowledge and agree that these third-party services operate independently and are governed by their own terms and privacy policies. Design-tokens.io is not responsible for the availability, performance, or security of these external services.
By using the Service, Users also accept the terms and privacy policies of these third-party providers:
Design-tokens.io reserves the right to change, add, or remove third-party services at its discretion. Users understand that their use of such integrations may be subject to additional terms imposed by the respective third-party providers.
To the fullest extent permitted by law, design-tokens.io shall not be liable for any indirect, incidental, consequential, or punitive damages arising from or related to the use of the Service, including but not limited to loss of data, business interruptions, or loss of profits. The Service is provided "as is" and "as available". While reasonable efforts are made to ensure its availability and security, design-tokens.io does not guarantee uninterrupted access or that the Service will be free from errors or vulnerabilities.
Users acknowledge that they are responsible for regularly backing up their data to prevent potential loss. Design-tokens.io shall not be held liable for any data loss, service disruptions, or technical malfunctions beyond its reasonable control.
Users agree to indemnify and hold harmless design-tokens.io from any claims, damages, or liabilities arising from their use of the Service or violation of these Terms.
Users may terminate their accounts at any time by contacting design-tokens.io support. Upon termination, access to the Service will be revoked at the end of the current billing period for paid plans or immediately for free accounts.
Design-tokens.io reserves the right to suspend or terminate any account if a User is found to be in violation of these Terms, engaging in prohibited activities, or otherwise misusing the Service. In such cases, termination may occur with or without prior notice, depending on the severity of the violation.
Upon termination, all data associated with the User’s account may be deleted, and design-tokens.io shall not be responsible for any loss of data resulting from such termination.
Design-tokens.io reserves the right to update or modify these Terms at any time. In case of significant changes, Users will be notified via email or through the Service. It is the User’s responsibility to review any updates, as continued use of the Service after the changes take effect constitutes acceptance of the revised Terms. If a User does not agree to the modifications, they must discontinue use of the Service.
These Terms shall be governed by and construed in accordance with the laws of Austria, including applicable regulations of the European Union. In the event of a dispute arising from or relating to these Terms or the use of the Service, the parties agree to first seek a resolution through negotiation. If no agreement is reached, disputes shall be settled through arbitration or mediation before pursuing any legal action in court.
The place of arbitration or mediation shall be in Austria, unless otherwise agreed by both parties. Any claims or legal proceedings must be conducted in the competent courts of Austria, subject to applicable jurisdictional rules.
These Terms constitute the entire agreement between Users and design-tokens.io regarding the use of the Service and supersede any prior agreements, communications, or understandings, whether written or oral. If any provision of these Terms is deemed invalid or unenforceable by a competent authority, the remaining provisions shall continue in full force and effect. The failure of design-tokens.io to enforce any right or provision under these Terms shall not be considered a waiver of such right or provision, nor shall it affect the ability to enforce it at a later time.
